Terms of Use
Last updated 30 October 2026
These terms are an agreement between you and Ricardo Guerreiro, Portugal, who runs Alpha State ("we", "us"). By using the app you agree to them. If you don't agree, please don't use the app. Questions: hello@alphastate.app.
1. Safety first
Alpha State is a wellbeing tool. It is not medical advice and does not diagnose, treat, cure or prevent any illness. Always listen to your body.
Where to practise
- Always sit or lie down somewhere safe and comfortable.
- Never practise while driving or operating machinery, in or near water (including the bath, pool or sea), while standing or walking, or anywhere a fainting spell could hurt you.
Who should ask a doctor first
Talk to a doctor before using Alpha State, and especially before Power Breath and breath-holds, if you:
- are pregnant;
- have epilepsy or have ever had a seizure;
- have a heart condition, high blood pressure, or have had a stroke;
- have a respiratory condition such as severe asthma or COPD;
- have a history of fainting, panic attacks or a mental health condition;
- have any other medical condition, are recovering from surgery, or take medication.
During practice
- Tingling, light-headedness and feeling warm or cold are common with fast breathing. They usually pass within moments of breathing normally.
- Stop immediately and breathe normally if you feel faint, dizzy beyond mild light-headedness, confused, or have chest pain, a racing or irregular heartbeat, or anything else that worries you. Seek medical help if it doesn't pass.
- Breath-holds are not a competition. Never force a hold or push through discomfort.
- Don't eat a large meal shortly before Power Breath.
2. Who can use Alpha State
You must be 18 or older. By creating an account you confirm that the email address is yours and that you will keep access to it secure. You're responsible for activity on your account.
3. Your responsibility
You choose when, where and how you practise, and you do so at your own risk. You agree to follow the safety guidance above and to use the app only for your own personal, non-commercial wellbeing.
4. Acceptable use
Please don't misuse the app: no attempts to access other people's data, overload or disrupt the service, reverse-engineer it to harm it, or use it for anything unlawful. We may suspend accounts that do.
5. Our content
The app, its design, guidance, sounds and the Alpha State name and logo belong to us. You may use them only within the app. The breathing techniques themselves are general practices and belong to no one; our presentation of them is ours.
6. The service
Alpha State is free. We work hard to keep it running and your data safe, but we provide it "as is" and can't promise it will always be available or error-free. We may change, add or remove features, or stop the service. If we ever shut it down, we'll give you at least 30 days' notice in the app so you can download your data.
7. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for harm resulting from using the app against this safety guidance. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your rights as a consumer under Portuguese and EU law.
8. Ending your use
You can stop using the app and delete your account at any time in Settings. We may close accounts that break these terms; where reasonable, we'll tell you first.
9. Changes to these terms
If we change these terms in a way that matters, we'll update the date above and ask you to accept the new version in the app before you continue.
10. Law and disputes
These terms are governed by Portuguese law. If you live in the EU, you also keep the protection of the mandatory consumer laws of your country and can bring claims in your local courts. We'd always rather sort things out together first: email us. EU consumers can also use the Portuguese consumer dispute resolution bodies.
Your privacy is covered in our Privacy Policy.
